B. END USER LICENSE AGREEMENT

Please read the following End User License Agreement (“EULA”), including all disclaimers and terms and conditions of use below, carefully before using the application. By using or accessing this application, you acknowledge that

(a) You are the either the principal researcher or a research administrator working under the directive of the principal researcher responsible for the research of any study that you post via this Application.

(b) You have obtained research ethics board (“REB”) approval for each and every study you post using this Application, and such REB approval includes approval for posting of the research study and recruitment using this Application.

(c) Your Research Institute (the institute for which you are affiliated, and under which this Study is being performed) has, or will promptly enter into an Agreement with University Health Network recognizing your participation and use of this Application for recruitment for the Study.

(d) You have read, understood and accepted the disclaimers and terms and conditions of use contained in this EULA and in the corresponding Consent and Privacy Policy, and accept all obligations and terms outlined within each, including all obligations regarding your use of any personal information (PI) and personal health information (“PHI”) disclosed to you through your use of this Application. More specifically you will not use the PHI alone, or in conjunction with any other information (including information that is available from other sources other than the Application) without the express written consent of both UHN and the Participant.

(e) You further acknowledge that any PHI disclosed to you through your use of this Application will only be provided to members of your study team of whom you have direct responsibility, who have need for such information, and who are under a legal obligation to maintain such information in confidence and not use such information except as specifically outlined herein.

(f) You acknowledge UHN’s zero tolerance policy for misuse of Participant’s PHI by either yourself or members of your study team, and UHN’s right to no longer permit yourself, or other members of your Research Institute further access to the Application.

If you do not accept any of the disclaimers or terms and conditions outlined above and further herein, you must not use the application.

Information in this application has been developed by UHN.

Governing Law and Jurisdiction. This EULA shall be interpreted under, and any action or claim arising from or related to the Application shall be brought in the courts of, and governed exclusively by the laws of, Ontario and Canada without regard to its conflicts of laws principles. Unless prohibited by applicable law, you expressly waive the right to participate in a class action proceeding.

4. Changes and Updates. UHN reserves the right to update or change information contained in the Application without prior notice or prior acceptance.

6. Purpose of Application. Connect1d Canada is a web-based software application. The Application is intended as a recruitment method for matching researchers of Type 1 Diabetes with people living with Type 1 Diabetes. It is also intended as a resource for people living with Type 1 Diabetes to learn about the research being conducted in Canada that they can participate in, along with the latest research findings. The Application is also intended as a registry of people living with Type 1 Diabetes. This Application is not a medical device. Nothing contained in the Application should be construed, directly or indirectly, as the practice of medicine or providing medical advice or medical services by UHN. The Application is not intended to diagnose, cure, mitigate, treat, or prevent disease or other conditions and the Participant is not necessarily under the care of UHN as a health institution. UHN does not independently verify information of Participants provided through the Application and Researcher’s should always engage in an independent and fulsome review of Participant’s eligibility for their Study.

7. No Regulatory Approval. The Application has not been evaluated by Health Canada, or any other domestic or foreign regulatory agency and is not approved to diagnose, treat, cure or prevent any disease or for the prescription of any medication or treatment. This Application is provided and designed for use in Canada.

8. Express Consent to Receiving Electronic Messages and Upgrades from UHN. By using the Application, you hereby expressly consent to receiving electronic messages from UHN, including alerts and reminders, information, notifications, requests for your feedback and other communications from UHN directly related to the Application and ongoing use by you of the Application.

C. COLLECTION OF DATA

DISCLAIMER. THE APPLICATION RECEIVES AND TRANSMITS YOUR ENTERED INFORMATION (WHICH MAY INCLUDE PERSONAL INFORMATION AND/OR PERSONAL HEALTH INFORMATION) OVER THE INTERNET. INFORMATION TRANSMITTED OVER THE INTERNET MAY BE AT RISK OF INADVERTENT LOSS OR THEFT. UHN CANNOT GUARANTEE THE SECURITY OF ANY INFORMATION TRANSMITTED TO OR FROM THE APPLICATION. BY USING THE APPLICATION, YOU AGREE THAT YOUR ACCESS AND USE OF THE APPLICATION AND THE CONTENT, INCLUDING BUT NOT LIMITED TO PERSONAL INFORMATION AND PERSONAL HEALTH INFORMATION, IS ENTIRELY AT YOUR OWN RISK AND LIABILITY.

D. USE OF DATA

The information provided by a T1D Participant to the Application is considered Personal Health Information, and includes the T1D Participant’s full name and contact information. The Participant only provides consent to release their full name and contact information to you SOLELY for purposes of contacting them for purposes of the specific REB approved Study for which they indicate an interest. No additional permission is granted to you, the Researcher, to use this information beyond the specific REB approved Study and any additional use, storage, or sharing of such information is specifically prohibited.

In addition, the Participant has provided to the Application additional information about themselves to allow the Application to better match the Participant User to the eligibility criteria listed by your Research Study. This additional information is not released to you the Researcher directly, however, it is possible that the fact that the Participant has matched the eligibility requirements of your Study may nevertheless provide to you, the Researcher, additional personal health information about such Participant. No permission is granted to you, the researcher, to use this additional information beyond confirming the Participant User’s eligibility for the specific REB approved study. Any additional use, storage, or sharing of such information is specifically prohibited.

D. LIMITED LICENSE

Through your account creation on Connect1d Canada, provided that you comply with the terms of this EULA, you are acquiring and UHN grants you a personal, limited, non-exclusive and non-transferable license to use the Application through your device for personal, non-commercial use solely as described herein.

(a) You are eighteen years of age or older, you have Type 1 Diabetes (T1D), and you are using this Application for your personal use and interest in participating in research studies around T1D, and not on behalf of another party.

(b) You have read, understood and accepted the disclaimers and terms and conditions of use contained in this EULA and in the corresponding Consent and Privacy Policy, and accept all obligations and terms outlined within each, including all obligations regarding the use and disclosure of any personal information (PI) and personal health information (“PHI”) submitted by you through your use of this Application. More specifically, you understand that your PHI will only be disclosed by the Application as outlined in the Consent and Privacy Policy.

(c) You are granting permission via the Application for disclosure of your PHI to the Researcher for use in contacting you for the specific Study and for no other purpose. The Researcher, and their Research Institute have agreed not to use the PHI except for purposes of the specific Study. UHN has a zero tolerance policy, and upon finding of any misuse, has the ability to prevent the Researcher and their Research Institute from any further access to the Application.

It is also intended as a resource for people living with Type 1 Diabetes to learn about the research being conducted in Canada that they can participate in, along with the latest research findings. This Application is further intended to support a registry of people living with T1D in Canada. Any use of the registry aspect of this Application, including any advocacy, marketing or fund raising shall only utilize aggregate/summary information and will not disclose individual level data. This Application is not a medical device. Nothing contained in the Application should be construed, directly or indirectly, as the practice of medicine or providing medical advice or medical services by UHN. The Application is not intended to diagnose, cure, mitigate, treat, or prevent disease or other conditions.

7. Not Medical Advice/No Obligation to Participate. The Application is not a substitute for professional medical advice, diagnosis or treatment. Nothing in this Application is intended as a sponsorship or support of any particular research study. You are free to participate or not as you wish, and any expression of interest in being contacted for a specific Study is not a commitment to participate in that Study independent of your additional written consent to participate. You are always free to seek the independent advice of your own physician or other qualified healthcare provider concerning questions you have regarding any study prior to participation. Never delay obtaining medical advice or disregard medical advice because of something you have or have not read on the App. If you have, or suspect you have, a health problem, or if you experience an adverse side effect, please consult your doctor. If you have, or suspect you are experiencing a health emergency, please call 911 and/or promptly visit a Hospital Emergency Department in your area.

8. No Regulatory Approval. The Application has not been evaluated by Health Canada or any other domestic or foreign regulatory agency and is not approved to diagnose, treat, cure or prevent any disease or for the prescription of any medication or treatment or as indication of their approval of any. Prior to allowing a Study to be posted on this Application, we require evidence that the Study has been approved by a research ethics board. No other review or approval has been determined. This Application is provided and designed for use in Canada.

9. Express Consent to Receiving Electronic Messages and Upgrades from UHN. By using the Application, you hereby expressly consent to receiving electronic messages from UHN, including alerts and reminders, information, notifications, requests for your feedback and other communications from UHN directly related to the Application, any applicable software updates or upgrades to the Application, ongoing use by You of the Application. Any additional contact by email is only as outlined in the Consent and Privacy Policy.

C. COLLECTION OF DATA

In addition, you have provided to the Application additional information about yourself (through one or more Questionnaires) to allow the Application to better match you to the eligibility criteria listed for each research Study. This additional information is not released to the Researcher directly, however, it is possible that the fact that You have matched the eligibility requirements of a Study may nevertheless provide the Researcher, additional personal health information about you.
